♥ Book Title : Law and Aesthetics
☯ Full Synopsis : "Law and Aesthetics draws on the work of poets as well as philosophers. Taking as its starting point Shelley's assertion that poets are unacknowledged legislators, the book suggests that there is a way of thinking that, as yet, has not been taken up by those who make use of literary aesthetics to understand law. The book tracks this aesthetic thinking through the failures of critical legal studies and stages an encounter with psychoanalysis, before suggesting that an aesthetics of law can be exhumed from Nietzsche's work. The aesthetic is a call to the creative: fashion new law. A review of contemporary legal theory that makes use of aesthetic perspectives suggests that dissident and radical "Nietzschean" energies continue to animate legal thought. In the final chapter, an aesthetics of law is shown to make for an interruption of legal categories, and the generation of new legal relationships. The book concludes with a further meditation on Shelley's poetry, and a call to continue in the spirit of aesthetic reinvention."Article| Adam Gearey| Statement ..."

♥ Book Title : Genres of Critique
☯ Full Synopsis : "The book seeks to open and explore the liminal space of critique at the intersection of law, aesthetics and politics. The essays in this volume elaborate and expand the meaning and significance of critique through an engagement with aesthetic forms. Although this endeavour has wider significance, the focus is primarily on South Africa. The various contributions arose out of a process of reading, writing and discussion among visiting scholars at the Stellenbosch Institute for Advanced Study (STIAS), Stellenbosch University, South Africa, in 2010. The project responds to the limits of the transplantation of critical legal studies into different jurisdictions, especially South Africa. The essays develop an approach to critical legal thinking that is conscious of critique as a problem of genre and seek to open up this problem of genre in the context of critical legal studies."Article| Karin van Marle| Statement ..."

♥ Book Title : Atmosphere and Aesthetics
☯ Full Synopsis : "This book provides a presentation of the concept of “atmosphere” in the realm of aesthetics. An “atmosphere” is meant to be an emotional space. Such idea of “atmosphere” has been more and more subsumed by human and social sciences in the last twenty years, thereby becoming a technical notion. In many fields of the Humanities, affective life has been reassessed as a proper tool to understand the human being, and is now considered crucial. In this context, the link between atmospheres and aesthetics becomes decisive. Nowadays, aesthetics is no longer only a theory of art, but has recovered its original vocation: to be a general theory of perception conceived of as an ordinary experience of pre-logical character. In its four parts (Atmospheric turn?, Senses and Spaces, Subjects and Communities, Aesthetics and Art Theory), this volume discusses whether atmospheres could take the prominent and paradigmatic position previously held by art in order to make sense of such sensible experience of the world."Article| Tonino Griffero| Statement ..."

♥ Book Title : The Criminal Spectre in Law, Literature and Aesthetics
☯ Full Synopsis : "This book analyses the legal and aesthetic discourses that combine to shape the image of the criminal, and that image's contemporary endurance. The author traces the roots of contemporary ideas about criminality back to legal, philosophical and aesthetic concepts originating in the nineteenth century. Building on the ideas of Foucault and Walter Benjamin, Hutchings argues that the criminal, as constructed in places such as popular crime stories or the law of insanity, became an obsession which haunted nineteenth century thought."Article| Peter J. Hutchings| Statement ..."

♥ Book Title : Justice Miscarried
☯ Full Synopsis : "The law is going through a period of deep crisis, exemplified by continuing revelations of miscarriages of justice, which calls for radical reassessment of the relationship betwen law and morality. The technocratic efficiency aimed at by modern law can no longer be perceived as a subsitute for the law's failure to deliver justice. This new study seeks to reopen the law-ethics debate from a postmodern perspective and calls for a radical reassessment of the relationship between law and morality. It argues that the separation between law and ethics led to the failure of the law to deliver its promise of justice and claims that only by taking seriously a philosophy of otherness can the law be transformed into an acceptable ethical basis of social communication; otherwise it will remain divorced from ethics and its decline into amoral technocratic management will continue. The authors of this book confront an issue of great contemporary concern in an innovative and often controversial way. Theories of justice and the place of otherness in them are examined in detail, and the tragedy of Antigone is presented as the foundational myth of legality. Casuistry, another forgotten tradition, often contrasted with the reason of the law, is next traced in the common law. Legal philosophies, and the ideas of Kant, Hegel, Heidegger, Derrida and Levinas, are discussed in an exploration of the ethical elements missing in modern justice. The ethics alterity is then applied to a series of cases dealing with refugees. The book concludes by proposing a theory of legal aesthetics through a reading of a Shakespearean sonnet and Sir Joshua Reynolds' discourses on art."Article| Costas Douzinas| Statement ..."
♥ Book Title : The Mysterious Science of the Law
☯ Full Synopsis : "Referred to as the "bible of American lawyers," Blackstone's Commentaries on the Laws of England shaped the principles of law in both England and America when its first volume appeared in 1765. Set against the intellectual values of the eighteenth century-and the notions of Reason, Nature, and the Sublime—Commentaries is at last fitted into its social setting.
